A COMMITTAL court in Waigani was informed that police had completed their investigations for the murder hearing involving Moresby North-West MP Lohia Boe Samuel and his co-accused Fabian Hera.
“We are in the midst of printing, photocopying and binding of the court documents,” police prosecutor Sergeant Chris Iga told magistrate Paul Puri Nii yesterday.
He said those were the instructions from the case informant and asked the court to give two weeks for police to complete and serve the files on Samuel and Hera.
Samuel is represented by Edward Sasingian and Hera’s defence counsel is public solicitor Friedrich Kirriwom.
Nii asked Sasingian and Kirriwom whether they had any objections to the two-week postponement and both did not object.
He then adjourned hearing to June 23 and extended both Samuel and Hera’s bails.
On March 11 between 7.15pm and 8pm, Samuel, 52, from Motu-Koitabu’s Elevala village in the National Capital District, and Hera, 26, from Koukou village in Motu-Koitabu, were having dinner in a restaurant in Waigani with Robert Jerry, 38, from Bulolo’s Lagis village in Morobe.
They were having some discussions during the meal when a disagreement allegedly arose.
Samuel allegedly drew his licenced firearm, loaded with five rounds of ammunition, and shot Jerry on the right side of his neck under his ear.
The bullet exited Jerry’s back close to the left, killing the father of seven almost instantly.
Samuel allegedly put the weapon on a seat, stood up, banged the table and yelled out Hera’s name twice saying, “Fabian why did you do that, why?” and he walked out.
Hera allegedly stood with his hands on his head looking lost.
A witness, Daniel Oaisa, who was seated close to them heard the gun shot, stood up and quickly walked over to pick up the pistol which was left on the seat pointing towards where Fabian was seated.
Oaisa then walked out with the pistol, unloaded its chamber.
Another witness, expatriate Lydia Kailap, who was having dinner with her family, walked over to try to help Jerry and called others to help while waiting for an ambulance.
Samuel allegedly walked out, got into his vehicle and drove away.
