Yama, Kramer among 16 summoned by National Court

PORT MORESBY: Madang Governor Peter Yama and Madang MP/Justice Minister Bryan Kramer have been summoned by the National Court to explain the bad road conditions in Madang town.

The two are among 16 respondents summoned by Human Rights Judge Justice David Cannings after a hearing in Madang last week (June 10, 2021).

The other respondents are:

> 1ST respondent Madang provincial government;

> 2nd respondent Madang District Development Authority;

> 3rd respondent Madang Urban Local Level Government;

> 4th respondent Provincial Works Manager, Works Department;

> 5th respondent Provincial police commander, Madang

> 6th respondent Commanding Officer, Beon Correctional Institution;

> 7th respondent Stephen Asivo, on behalf of vehicle owners, Madang town;

> 8th respondentRamsey Pariwa, vehicle owner, Madang;

> 9th respondent Young Wadau, vehicle owner, Madang;

> 10th respondent Sama Mellombo, vehicle owner, sewrvice provider and community leader;

> 11th respondent Mary Kamang, women’s leader, Madang;

> 12th respondent John Wowonam, service provider to Madang provincial government;

> 13th respondent The Independent State of Papua New Guinea;

> 14th respondent MP/Madang Governor Peter Charles Yama; and

> 15th respondent Madang MP Bryan Kramer; and

> 16th respondent Treasury secretary Dairi Vele.

Justice Cannings ordered the respondents to appear in court on Oct 21, 2021 to explain steps taken concerning the bad state of Madang town’s roads.

The hearing followed a notice and summons issued by Justice Cannings at Waigani on June 1, 2021.

The notice was issued regarding the effect of dilapidated road conditions on enforcement of human rights in Madang town.

It said further to the notice of intention to summon issued on April 30, 2021, whereas it appeared that the following orders of the National Court have not been complied with by the persons and authorities subject to these orders.

The notice listed four orders.

Madang Governor Peter Yama, Madang MP and Justice Minister Bryan Kramer are among ordered to appear in Court or be legally represented on Oct 21, to answer to the court’s directions concerning the bad state of Madang’s roads.
Human rights Judge Justice David Cannings issued the order after a hearing in Madang last week.
Justice Cannings also ordered Treasury Secretary Dairi Vele, the Provincial Works Manager, the Madang government and the Madang development authority to appear in Court in person or be legally represented in court on Oct 21 to explain steps taken concerning the bad state of Madang town’s roads.
The case concerns the court’s inquiry into the effect of the dilapidated road conditions on enforcement of human rights in Madang town.
Last week, Justice Cannings issued various orders.
These included that the road works on the most dilapidated sections of Modilon Road, Handy Mart Junction, Modilon Hospital, Tusbab Secondary School and Andersons Foodland shall be completed by Oct 17.
And road works on other sections of Modilon Road shall be completed in accordance with further orders of the court.
The Court ordered that the Madang finance manager shall by June 30:

· Release K5 million of the K10.9 million deposited into Madang development authority operating account for Madang town roads shall be paid to Madang District Works and Equipment Ltd to fund the implementation of the Modilon Roads; and,

· Raise a cheque of K15 million from the Madang development authority district service improvement funds made payable to Madang District Works and Equipment Ltd to procure works and plant equipment in compliance with legislative procurement requirements.

The Court ordered that Vele shall by June 30, take all steps necessary to release by electronic transfer to Madang development authority operating account, the K10 million appropriated in the 2021 budget for Madang town roads to Madang development authority.
The Court also ordered Yama, Kramer, Vele, the provincial works manager, the Madang government and the Madang development authority to file an affidavit by Oct 18 deposing to all steps taken to implement the court’s orders of Jan 30 and Feb 12.
