A WOMAN who stabbed her ex-husband to death with a kitchen knife on Oct 24, 2019, was yesterday jailed 13 years with hard labour by the Waigani National Court.
In sentencing, Chief Justice Sir Gibbs Salika told Mari Dominic, from Tapini’s Tanipa village, Central, that there were many people in the country carrying around pocket knives “which is not a good idea”.
Dominic had pleaded guilty to a charge of manslaughter.
“Manslaughter cases are still prevalent and becoming more daring,” Sir Gibbs said.
“There are too many of you, men, women, everywhere around the country, carrying pocket knives.
“Why are you carrying pocket knives, I would not know.
“Perhaps you are carrying (knives) for your own self-defence or some other reasons.
“It is not a good idea to carry such offensive weapons in your trousers or pockets or bags or bilums or whatever.
“Knife has a purpose.
“It was made for a purpose but not for killing or injuring people.
“You did not stab him at another part of his body.
“You stabbed him below the shoulder.
“Below the shoulder is where the heart and the major organs are located.
“You aimed at the right place and then your man did not last long as a result of the stab wound.”
Sir Gibbs told Dominic that although she tried to defend herself, the knife attack on the deceased was more than what she could have done to him.
Sir Gibbs told Dominic that she could have restrained herself not to kill him but to only injure him or disable him but “you killed him”.
In mitigation, Dominic pleaded guilty, was a first time offender and had surrendered to police whilst in aggravation, a dangerous weapon was used leading to the loss of life.
Sir Gibbs deducted one year and eight months spent in custody, leaving Dominic with a jail term of 11 years and four months to serve in Bomana. He told Dominic that parole was at the discretion of the Correctional Services (CS) as long as she behaved and cooperated with them (CS).
Dominic stabbed her ex-husband on Oct 24, 2019, at about 2am in China Quarry, Sabusa settlement, along the Hiritano Highway in Central. Before the incident, Dominic’s ex-husband approached her and argued with her regarding their separation three years ago. She surrendered to police after stabbing him.
