AN 80-year-old man who admitted to sexually touching a five-year-old girl had his jail term suspended by the National Court in Waigani yesterday.
Justice Teresa Berrigan suspended Andrew Gemu’s sentence due to his old age and “strong prospects of rehabilitation”.
“You are to go home and be under good behaviour and not commit any crime at all,” she told the Central octogenarian.
“If you ever get caught for committing any crime, you are to come back and serve the balance of your term that was suspended.”
Justice Berrigan had jailed Gemu for four years.
She deducted one year, four months and 24 days from the jail term for time spent in custody.
The balance of two years, seven months and six days was suspended.
The court heard that on June 9 last year, Gemu was caught touching the private part of the five-year old girl who was his neighbour at Morata in the National Capital District.
He was doing that while talking to the victim.
The victim’s older sister, six, saw what the accused was doing.
The accused stopped immediately when he realised he was being watched.
The two girls ran into the house, reported the matter to their parents who then reported it to the Gordon Police Station.
Since then, Gemu was held in custody at Bomana awaiting his trial until he appeared in court yesterday.
