Sir Puka cleared of misconduct charges

PORT MORESBY: A Leadership Tribunal has cleared Abau MP Sir Puka Temu pf two allegations of misconduct in office because of discrepancies in the evidence submitted.

Tribunal chairman Justice Panuel MOgish said none of the evidence provideded  for any element of the allegations of misconduct against Sir Puka.

A LEADERSHIP tribunal has cleared Abau MP Sir Puka Temu of the two allegations of misconduct in office against him, because of discrepancies in the evidence submitted.
Tribunal chairman Justice Panuel Mogish said none of the evidence provided supported any element of the allegations of misconduct against Sir Puka.
He said: “The consequence of not properly identifying the companies’ names was very serious in (his) prosecution.
“The tribunal is concerned in the correct identity of the entity in question as per the requirement of the Companies Act, and not of what the leader or department heads thinks.
“The correct naming of the companies was a critical element of fact and law.
“The issue of the conduct of (Sir Puka) becomes important once the companies were properly identified.
“Every piece of evidence during the investigation must be scrutinised properly and verified by the Ombudsman Commission before referring it to the public prosecutor.
“Referring unverified document to the public prosecutor falls short of a constitutional requirement.
“Verifying of documents must be done responsibly and professionally bearing in mind as a small mistake can lead to dismissal of office, integrity and reputation of MPs.”
Sir Puka was charged with two counts of office misconduct in the allegations of awarding a contract for refurbishment and construction of a multi-storey government office complex to Niame Investment Ltd and Central Lands Ltd.
