Judge warns Madang Gov Peter Yama, others

PORT MORESBY: Madang Governor Peter Yama, Treasury secretary Dairi Vele and Madang administrator Clement Tare were warned by a judge that they would be held with contempt if they failed to turn up for court hearing on Jan 13.

Justice David Canning on last Thursday (Oct 21, 2021) issued the warning after they failed to appear in the National Court inquiring into the effect of the dilapidated road conditions on enforcement of human rights in Madang town.

A JUDGE has warned Madang Governor Peter Yama, Treasury secretary Dairi Vele and the Madang administrator Clement Tare that failure to appear in court will lead to contempt charges.
Justice David Cannings issued the warning after they failed to appear at the National Court in Madang last Thursday. The case concerns the court’s inquiry into the effect of the dilapidated road conditions on enforcement of human rights in Madang town.
“It is recorded that there was no appearance by the following respondents (Yama, Vele and Tare) who are each warned that continuing failure to comply with court orders will lead to charges of contempt of court,” he stated in the order.
Justice Cannings ordered that Works secretary David Wereh and Madang MP Bryan Kramer continue discussions of issues concerning inspection of works being done on the Modilon Road.
Justice Cannings stated that if Wereh and Kramer reached an agreement, a document bearing the signature of these two leaders might be submitted to the court.
“If there is no agreement or one of them prefers a notice of motion seeking an amendment or addition to these orders may be filed in the Madang registry of the National Court and set down for hearing in Waigani before the next scheduled hearing of these proceedings in Madang,” he stated.
The matter has been adjourned to Jan 13.
The Madang Urban Local Level Government, Madang police commander acting Supt Mazuc Rubiang, women’s leader Mary Kamang, service provider to the Madang government John Wowonam, the State and vehicle owners of Madang Town – are the other defendants in the case.
