Juvenile left in custody for about a year without police files

PORT MORESBY: Can you image a 17-year-old boy held in custody for about a year without any police files?

The boy was just left to “rot” in the cell and his lawyer will be filing an application under Section 37 of the Constitution in the next court hearing.

A 17-YEAR-OLD boy, charged with murder, has been held in custody for a year, a committal court in Waigani was told yesterday.
“This is why we will be filing an application under Section 37 of the Constitution in the next hearing,” defence counsel Emmanuel Ellison, representing Joshua Bruce, from Kagua-Erave’s Simbori village, South Highlands, said.
“Bruce is a juvenile and has been in custody for almost a year without police files,” he said.
Police prosecutor Sergeant Christian Iga informed the court that Bruce had gone for a record of interview with the police and the medical reports were also ready.
“Police files are almost completed but we are only waiting for the photographs of the crime scene from the forensic office,” Iga told the court.
“I was informed by the case informant that the officer in-charge of forensic is out of the country, so there is a delay in getting the photographs.
“I seek leave from court for an adjournment to prepare the files and present it before the court in the next date of hearing,” he added.
Magistrate Paul Puri Nii told Ellison that he could file his application under section 37 of the Constitution for him to consider.
On Jan 1, at Eight-Mile, Bruce and his brother Lakura Bruce were allegedly drunk and smashing empty bottles in front of a trade store.
The store owner tried to stop Joshua and Lakura but they allegedly attacked him.
A fight broke out with bystanders and but the two allegedly continued to behave aggressively.
Lakura allegedly grabbed a broken lid from a damaged fridge and hit the store owner on the head.
He was rushed to the hospital but was pronounced dead on arrival.
