Fabian Hera says he did not have gun

PORT MORESBY: Fabian Hera, who is accused along with Moresby North-West MP Lohia Boe Samuel of killing Robert Jerry in a restaurant with a gun belonging to the MP, has maintained that he never held the gun on the fateful night.

Hera made the claim when presenting his Section 26 statement yesterday (Oct 31, 2022). Samuel chose to remain silent.

Both Samuel, a member of the ruling Pangu Pati, and Hera have been committed by a committal court in Waigani to stand trial in the National Court for murder.

THE man accused along with Moresby North West MP Lohia Boe Samuel of killing Robert Jerry in a restaurant by allegedly shooting him with a gun belonging to politician, Fabian Hera, has maintained he never held the gun on the fateful night.
Hera made the claim when presenting his section 26 statement yesterday.
Hera’s lawyer Fredrick Kirriwom from the Public Solicitors Office tendered a copy of his client’s section 96 statement and informed the court that Hera would read his statement.
“My client Fabian Hera will have the opportunity to read his statement to the court,” Kirriwom said.
Hera informed the court through his section 96 statement that he had never asked to retrieve the firearm and magazine from Samuel’s vehicle.
“I did not, at any point, return to Mr Samuel’s vehicle to retrieve the firearm and magazine,” Hera said.
“Sgt Nei Pige had demanded for the firearm that time and the magazine was passed on to me by another policeman who was in uniform.”
Hera said he had stuck with the same account of the events that happened that night ( March 11, 2022).
“I reiterated my statements and the record of interview,” he said.
Meanwhile, Samuel’s lawyer Edward Sasingian informed the court that his client would not be responding to justify the allegation.
“My client Lohia Boe Samuel has decided to remain silent,” Sasingian told the court.
Waigani Committal Court magistrate Paul Puri Nii told Hera and Samuel that the purpose of section 96 was for the defendants to say something in respect to the decision.
“Fabian has presented his section 96 statement and Samuel decided to remain silent which is his constitutional right to do,” Nii said.
“Evidence was sufficient to commit both defendants for the offence of murder under section 300 of the Criminal Code Act.
“My decision on section 100 of District Court Act is intact and both defendants are now committed to stand trial in the National Court.”
The matter returns for trial in the National Court on Nov 8.
