MORESBY South MP Justin Tkatchenko claims Committal Court Magistrate Paul Puri Nii had erred in his ruling based on (alleged) false information presented in court.
“The Oct 27 ruling to dismiss my defamation suit against Robert Agen was (allegedly) baseless,” he said.
“I reported the matter to police last year when Agen made defamatory comments against me that I transferred land that belonged to the people of Central to my family business.
“It should be clear that I was the one who initiated the defamatory case against Agen for falsely accusing me of transferring land titles.
“The accusation was false which was totally irresponsible and defaming because it never happened.”
Tkatchenko said he was surprised when Nii ruled that the land at 14-Mile (Adventure Park) was supposedly transferred under his family business.
“Where are the transfer documents that state the transfer and title of the land when the court made the ruling?” Tkatchenko said.
He claimed that the documents did not exist because the transfer never happened, which was serious and needed to be looked at.
“Nii has been lied to, misled and given false information by Agen which resulted in his (Nii’s) decision,” he said,
“We will be pursuing this matter upon seeking legal advice on grounds that there was no such transfer of land in Central.”
Tkatchenko also took offence at former Opposition Leader Patrick Pruaitch’s statement based on (alleged) false information that were presented to the court by Robert Agen.
Pruaitch had called on Tkatchenko to resign immediately due to the court ruling that the latter was involved in the (Adventure Park located at 14-Mile) land-grabbing episode.
Tkatchenko said pursuing the matter would not only mean to resurrect and challenge the court’s decision last week, but also take Pruaitch to task for commenting on (alleged) “false and fake information” and defaming him.
