Young and Williams Lawyers former legal assistant to be tried in National Court on 53 fraud charges

PORT MORESBY: A former legal assistant at Young and Williams Lawyers is to be tried in the National Court on 53 counts of fraud-related charges.

Committal court magistrate Danny Wakikura told Tabitha Malken, from Wosera-Gawi’s Jambitanget village in East Sepik, that there was enough evidence to try her case.

This follows Malken’s decision to remain silent when asked by the court to make her declaration statement last week.

Malken was lawyer Gloria Salika’s assistant. Gloria is Chief Justice Sir Gibss Salika’s daughter.

Gloria, a co-accused, is awaiting a ruling in her case in the same court. She is charged with 26 counts misappropriation, 28 counts of money laundering, 27 counts of false pretense and two counts of conspiracy to defraud in facilitating a transfer of K15 million belonging to the Western people to the law firm.

Wakikura is scheduled to make a ruling on Gloria’s case today (May 5, 2022).

A FORMER legal assistant at Young and Williams Lawyers is to be tried in the National Court on 53 counts of fraud-related offences.
Committal court magistrate Danny Wakikura told Tabitha Malken, of Wosera-Gawi’s Jambitanget village in East Sepik, that there was enough evidence to try her case.
He said whether Malken committed the crime or not was for the National Court to decide through a proper trial.
This follows Malken’s decision to remain silent when asked by court to make her declaration statement last week.
The court had found sufficient evidence against her on April 13.
Magistrate Wakikura in his ruling said the evidence in relation to the charges of misappropriation, dealing with criminal property of money that was questionable and conspiring appeared to be sufficient.
He added that committing Malken to the National Court would allow her to defend herself properly in the trial to clear the charges against her where she had every right to question the evidence.
Malken was charged with 17 counts of misappropriation, 16 counts of false pretence, 18 counts of dealing with criminal property and two counts of conspiracy for allegedly being involved in facilitating the transfer of K15 million from Australia New Zealand (ANZ) Bank account belonging to Western people to a law firm.
Police alleged that between Aug 1 and Aug 30, 2018, Malken while employed with Young and William Lawyers allegedly communicated with (ANZ) bank employees and facilitated a transfer of K15 million from Western people’s dividend trust account to Young and William Lawyers trust account with Bank South Pacific Financial Group Ltd.
