Election petition against Juffa to proceed

PORT MORESBY: The National Court in Waigani has allowed an election petition against Northern Governor Gary Juffa to proceed to trial although petitioner Jean Parkop failed to file and serve extra affidavits on time.

Judge Joseph Yagi said the trial would be heard in Popondetta.

THE National Court in Waigani has allowed a petition against Northern Governor Gary Juffa to proceed to trial although petitioner Jean Parkop failed to file and serve extra affidavits on time.
Judge Joseph Yagi said the trial would be heard in Popondetta.
Juffa’s lawyer, Alois Jerewai, said that he nor his client had received any notice of the affidavits.
“There was an indication made before this court by Parkop to file and serve extra witness statements by Jan 12, but that has not been done,” he said.
It was noted that Parkop and her lawyer were not in court yesterday to give an explanation.
Judge Yagi said March 6 and 7 trial date as set last year would proceed.
“If there are no affidavits, there is nothing further to consider and matter is ready to move forward,” he said.
Meanwhile, West New Britain Governor Sasindrian Muthuvel will be moving to dismiss a petition against him by Gari Baki. Muthuvel’s lawyer Michael Kuma yesterday asked the court to hear the application but Judge Yagi said the consequences would be serious and Baki must respond within the next seven days.
“The consequences will be serious and before I hear the application to summarily dismiss the petition and make a ruling, you and your lawyer must respond,” Judge Yagi said.
Muthuvel had filed a previous application to have the petition dismissed, which Judge Yagi ruled in Baki’s favour, giving an extension of time for them to provide affidavits.
“The first respondent (Muthuvel) is alleging that you did not comply with a court order made on Dec 19 after you were granted leave for extended time to file and serve affidavits,” Judge Yagi said.
Baki, who appeared in person yesterday, told the court that his lawyer Emmanuel Korua had issues renewing his practicing licence and therefore, could not be present.
Judge Yagi said Muthuvel’s application will be heard on Jan 24.
