PORT MORESBY: The Waigani committal court has accepted the age of a girl who allegedly filmed herself molesting a 13-month-old toddler in Port Moresby in October as 17,

Magistrate Paul Nii granted the girl bail and regarded the case as juvenile.

He said he was satisfied with the girl’s age upon her mother’s statement.

“I accept her age as 17 since her mother flew in from Wabag to Port Moresby and told the court of the date of birth.

“Though there is no birth certificate and clinic book to confirm, a mother always remembers when she delivered her child,” he added.

A COURT has accepted the age of a girl who allegedly filmed herself molesting her 13-month-old nephew last year in Port Moresby as 17 years old, granted her bail and regard the case as juvenile.
Magistrate Paul Nii, at Waigani Committal Court yesterday, when granting bail to the girl from Lanemanda village in Wapenamanda, Enga, said he was satisfied with the girl’s age upon her mother’s statement.
“I accept her age as 17 since her mother flew from Wabag to Port Moresby and told the court of the date of birth,” he said.
“Though there is no birth certificate and clinic book to confirm, a mother always remembers when she delivered her child.”
Magistrate Nii said another reason for granting the bail was that the girl was intimidated by a police officer while she was detained at Boroko holding cell.
“No police personnel or person has the right to harass or intimidate an accused in custody because the matter is already in court and they are in prison,” he said.
“Let the law take its own course in court through the process.
“The girl is a 17-year-old child and should not be called names to harass her.”
Magistrate Nii said he refused the girl’s previous bail as there was no birth certificate and clinic book to confirm her age and it was not in the interest of justice as a toddler was sexually abused.
“I refused to accept her age when the guardian came to confirm the age because there was no evidence,” he said.
“Now that the mother had confirmed the girl’s age, the court was satisfied and the case is transferred to the Juvenile Court.”
Police alleged that the girl, between last Oct 1 and Oct 31, made a video undressing herself and sexually abusing the toddler while she was supposed to babysit the victim and three other kids.
It was alleged that the phonography she produced with the toddler was edited to 2.24 minutes, posted on Facebook and went viral.
The video came to the attention of the police and the girl was arrested on Jan 24 and was out on K1,000 bail.
She returned to custody last month after she went to court to be arraigned due to the confusion about her age.
