All clear for Papua New Guinea’s K151b gas project

PORT MORESBY: All is clear for the K151 billion (US$44 billion) P’nyang gas project to be launched after North Fly MP James Donald withdrew his case against the Government, Petroleum Minister Kerenga Kua and ExxonMobil.

Lawyer Raphael Saulep informed the court on Friday (March 4, 2022) that Donald decided to withdraw the case because what he intended to stop had already been signed.

“Donald has accepted that the agreement between the Government and ExxonMobil was signed and wishes to withdraw the proceeding,” he added.

NORTH Fly MP James Donald has withdrawn his case against the Government, Petroleum Minister Kerenga Kua and ExxonMobil to stop the K151 billion (US$44 billion) P’nyang gas project agreement.
Donald’s lawyer Raphael Saulep informed the court that Donald decided to withdraw the case because what he intended to stop had already been signed.
“Donald has accepted that the agreement between the Government and ExxonMobil was signed and wishes to withdraw the proceeding.
“We also ask the court to order for the cost of the proceedings to be paid on party-party basis,” he added.
Acting judge Justice Emma Wurr in the National Court in Waigani on Friday granted leave to withdraw the case.
Justice Wurr further ordered Donald to pay the cost of the proceedings, saying that the matter was a matter of discretion.
Esso (PNG) P’nyang Ltd’s lawyer Mek Tumul said the application made on Feb 21, to obtain the stay order was made on the wrong mode of proceedings and had misled the court.
“Order as such should not be obtained without proper originating summons.
“The plaintiff should pay the cost of the proceedings and must be paid before filing any application on this matter, if they wish to,” he added.
Solicitor-General Tauvasa Tanuvasa did not object Saulep’s application to withdraw the proceedings.
“We have no issue with withdrawing the proceedings as we have also filed the notice of motion to dismiss the proceedings earlier.
“They can withdraw the proceedings as long as they agree to pay the costs,” he added.
