Rapist cannot be trusted around any young girl: Judge

PORT MORESBY: A judge told a man that he could not be trusted around any young girl and jailed him 22 years for raping his 14-year-old daughter in Port Moresby three years ago.

Acting judge Laura Wawun-Kuvi told the rapist that no part of the sentence would be suspended as the offence was serious, violent and very prevalent in society.

“The sentence must reflect to show that society does not approve of such behavior,” she added.

A JUDGE told a man that he could not be trusted around any young girl and jailed him 22 years for raping his 14-year-old daughter in Port Moresby three years ago.
Acting Judge Laura Wawun-Kuvi told the rapist that no part of the sentence would be suspended as the offence was serious, violent and very prevalent in our society.
“The sentence must reflect to show that society does not approve of such behaviour,” she added.
Judge Wawun-Kuvi told the rapist that she was his biological daughter and he was supposed to love and care for her. “The things that you did (to her) should not have happened.”
Judge Wawun-Kuvi said the incidence of abuse committed against the child were depraved although the child grew up with her mother.
“To pose such primal intention on your own child demonstrates that you cannot be trusted around any young girl,” she said.
“While community leaders spoke favourably of you, these offences were committed in the home setting away from the eyes of the community and church leaders,” she said.
“She (daughter) finds it difficult to socialise with her friends and feels unwanted, depressed and unsafe around men and has lost trust for male relatives.
“She has sleepless nights and cries when she thinks about what happened to her.
“The offence has affected her academic performance and has left a scar on her that has affected her physically, mentally and emotionally.”
Judge Wawun-Kuvi said the victim’s impact statement spoke volumes on the irreparable damage this offence has caused.
She said the rapist had also assaulted his wife on one occasion when she found him abusing his daughter and that did not stop him from continuing with such sexual attacks.
“The only way he was stopped was when the daughter mustered the courage to report to her mother,” she said.
“The wife has pleaded to have mercy on her husband but it was viewed lightly because she had failed to remove the child from the abusive situation.”
The girl had grown up with her mother and her family until she was 13 when her father decided to bring her to live with him and his family in Port Moresby.
It was during this period when she resided with her father that he started abusing her. On March 1 and March 13, 2018, she was awakened by her father and told to go to his office where he would give her money.
In the office, he grabbed her shirt and hit her when she resisted.
He raped her, and repeated it two weeks later at home.
On Nov 1 and Nov 31, 2018, he again told the daughter to go in his office where he raped her.
The girl finally reported everything to the mother on July 21, 2019, who then took her to a family support centre for medical examination.
She reported the matter at the Boroko police station and her father was arrested on Oct 2, 2019.
