PORT MORESBY: Public servants living with unexplained
wealth will now be investigated and prosecuted by the state, Immigration and
Border Security Minister Bryan Kramer says.
This follows the passing
of the Proceeds of Crime Bill 2022 in Parliament on Thursday (April 21, 2022).
The bill, when gazette,
also covers provisions on unexplained wealth for current or previous wealth of
a person.
“The unexplained wealth
provision will be used against a person whose wealth exceeds that which cannot
be explained by their legitimate income,” Kramer said.

This follows the passing of the Proceeds of Crime Bill 2022 in Parliament on
Thursday.
The Bill, when gazetted, also covers provisions on unexplained wealth for
current or previous wealth of a person.
“The unexplained wealth provisions will be used against a person whose wealth
exceeds that which cannot be explained by their legitimate income,” Kramer
said.
“The state will need to demonstrate to the court that it has legitimate grounds
for suspecting that a person has unexplained wealth and they must provide
appropriate explanation proving that the wealth was acquired legitimately.”
The law will apply to public officials who have engaged in one or more
indictable offences without giving sufficient explanation.
“The state may apply to the court for an unexplained wealth order against a
public official,” he added.
Kramer said the value of the unexplained wealth would be calculated by
subtracting the person’s lawfully acquired wealth from their total wealth and
the amount calculated must be paid to the state under the law.
He said the law would strengthen provisions concerning cross-border movement of
currency and other items of value, provide new powers on confiscation, and
measures to combat money laundering.
