THE NATIONAL Court has found Robert Agen guilty on two counts of assault causing grievous bodily harm and one count of rape against his former girlfriend Hennah Joku.
Agen, a National Capital District regional candidate, from Aregol village, Sinasina-Yongomugl, Chimbu, was alleged to have assaulted and raped his ex-girlfriend Hennah Alwina Joku at Ower’s Corner in Sogeri, Central, on April 30, 2018.
He was also alleged to have assaulted Joku after returning from a fundraising event at Waigani, NCD, on Sept 15, 2018.
Acting Judge Tracey Ganaii told Agen, 48, that the court was satisfied that Joku’s account was truthful. “I have assessed both the defence and the State’s submission and I am of the view that the complainant’s statement was consistent all throughout with credibility that is satisfactory to the court,” she said when finding him guilty of the charges.
“Apart from the state witnesses which I fould credible and coherent, there has been admission on the record of interview (ROI) provided before the court without objections, determining circumstances of the incident.
She said the court did not consider the past sexual history of either party when making its ruling but relied solely on the evidence.
Ganaii said Agen’s ROI had been dishonest while Joku’s account had credibility.
“The accused did not tell the truth and I refuse to believe what was said as it was unreliable,” she said.
“He did not dispute her story.
“He did not call the name of the boy who went with them.”
Ganaii extended bail for Agen until today.
