Sodomy suspects granted K700 bail each

PORT MORESBY: Two men, charged with having anal sex in a health centre in Morobe last month were each granted K700 bail by a committal court in Lae yesterday (Dec 5, 2022).

Magistrate Lorna Sani said Kiru Leahy, 41, and Buru Samuel, 39, allegedly committed the offence out of the order of nature and an infringement of the Constitution.

TWO men accused of having anal sex at a health centre in Morobe last month were granted bail by the Lae Committal Court yesterday.
Kiru Leahy, 41, from Markham’s Urai village and Buru Samuel, 39, from Marasawa village also in Markham, Morobe, were each ordered by Magistrate Lorna Sani to pay a bail of K700. Both men were charged with committing an unnatural offence.
Sani said in court that the alleged offence committed by Leahy and Samuel was out of the order of nature and an infringement of the Constitution.
Police had earlier asked the court to issue a higher bail due to the type of offence.
Lawyer Cedric Kesambo, who represented Leahy and Samuel, opposed the police request.
Sani, after considering submission from the parties and the relevant law, granted each man a bail of K700.
The court also ordered the accuseds’ two guarantors to each pay K200.
Police allege that on Nov 18 at Mutzing health centre at about 11.30pm Leahy and Samuel were engaged in anal sex.
The court heard that both men were drunk and took no notice of anyone. The court also heard that witnesses then reported the matter to police in Mutzing.
Police, upon arriving at the location, found both men deep asleep beside each other before they were arrested.
The case will return to court on March 27.
