A MAGISTRATE has given a month to the wife of Tambul-Nebilyer and Defence Minister Win Bakri Daki to file her declaration (section 96) statement.
Esther Daki was charged with two counts of misappropriation and stealing for allegedly putting to her own use K4 million belonging to her husband’s company four years ago.
Waigani Committal Court Magistrate Danny Wakikura told Esther to gather all relevant bank transactions to file in her Section 96 statement when the case returns on Jan 14.
“You are given a month to file your section 96 through your lawyer with the all the attachments of the bank transactions and closed circuit television (CCTV) footage,” Magistrate Wakikura told Esther Daki.
Esther Daki’s lawyer Nellie Kepo informed the court that the reason why the Section 96 was not ready yesterday was because she was yet to get the CCTV footage to identify who had made the transaction.
“I will need to file a search warrant to get the CCTV footage to support the bank statements and to identify who was using the transactions before filing my client’s section 96 statement,” she told the court. Police alleged between Jan 10, 2018, and June 25, 2018, Esther Daki allegedly transferred the money from Weklwm Ltd and its subsidiary hire car and logistics company account into her personal account using cheque deposits.
Weklwm Ltd and its subsidiaries were incorporated in 2007 and Win Bakri Daki was the only shareholder of the company with Esther Daki as its secretary.
Win Daki appointed Esther and son Joshua as company directors on July 18, 2017, after he was declared Tambul-Nebilyer MP.
Esther was then appointed managing director the next day to oversee the operations of Weklwm Ltd and its subsidiaries.
Police alleged that she did not inform her husband, who was the company’s only shareholder, about the transfers and in doing so she had intended to steal the money.
Esther Daki in her submission last month asked the court to dismiss her case because the charge was falsely laid against her by her husband.
She said money was withdrawn with Daki’s knowledge that he had already recouped K3.035 million and the remaining balance was used for its intended purpose.
