K5 million misappropriation charge against former NHC boss
dropped
PORT MORESBY: The National Court on Friday (Dec 9, 2022)
dropped the K5 million misappropriation
charge against former National Housing Corporation (NHC) acing
managing-director Ditha Morris Nayabbanung.
The State told Judge
Teresa Barrigan in Waigani that it would not proceed with the case and filed a nolle prosequi (no wish to prosecute).

FORMER National
Housing Corporation acting managing director Ditha Morris Nayabbanung accused
of misusing K3.5 million had the misappropriation charge against him dropped by
the State on Friday.
The State told the Judge Teresa Berrigan at the National Court in Waigani that
it would not proceed with the case and filed a Nolle prosequi (no wish to
prosecute).
Berrigan accepted the State’s application and discharged Nayabbanung.
Nayabbanung’s lawyer Elah Nalea told The National after the
Court’s decision on Friday that he had written to the Public Prosecutor Pondros
Kaluwin outlining important facts and circumstances for the trial.
“But through that we found out there was no evidence to continue the case,” he
said.
Nalea said Nayabbanung was charged with misappropriation after his conspiracy
charges were dropped in the Committal Court.
It was alleged that between Aug 24 and Sept 21, 2017, Nayabbanung dishonestly
applied for his own use and to the use of others transferred land titles known
as the Duran Farm portion 528 worth K3.5 million of the public investment
programme appropriation.
He was suspended in 2017 as National Housing Corporation acting managing
director pending an investigation into the supervision of the delayed
Government’s Durand Farm housing project.
An emotional Nayabbanung told The National on Friday that the court had been
fair in its ruling and he was thankful to the arresting officer behind his case
for the last five years.
Nalea from Paul Othas Lawyers said he appreciated the State’s position and
asked for Nayabbanung’s bail money to be refunded.
