THREE men, charged with attempted murder in Port Moresby last year, had their request for out-of-court settlement denied by the Waigani Committal Court.
Prosecutor Sergeant Peter Samghy responded to the defence submission that the request could not be considered.
“The matter is already before the court and this court is not in the position to have the matter negotiated,” he said.
“Therefore, the matter should be raised in the National Court.”
Magistrate Danny Wakikura then asked the trio whether they had anything to say with regard to the prosecution’s objection, but they had no response.
Magistrate Wakikura then extended their K500 bail each and adjourned the matter to Feb 22 for ruling.
In the dock were Francis Albert, Albert Kita and Airi Albert, all from Tapini in Central.
On July 17, between 10am and 10.30am at Baruni Dump, Peter Mangai was with his daughter and relatives at a feast.
At the feast, Airi confronted Mangai with a homemade six-round pistol pointed at his chest and asked Yu tasol ah? (You are the one?).
In defence, Mangai swung a bush knife at Airi, hitting the pistol which dropped on the ground.
Francis and Kita then held Mangai while Airi’s father Albert swung a bush knife aimed at Mangai who managed to avoid.
Mangai was then stabbed on his shoulder with a kitchen knife by the men restraining him.
As Mangai tried to free himself, Francis shot him on the right side of his shoulder with a homemade gun.
The matter was then reported to Gerehu Police Station on Aug 8 and the trio were arrested.
