Court refuses to hear Jamie Pang’s application to see lawyers

PORT MORESBY: Deputy Chief Justice Ambeng Kandakasi has refused to hear Sanctuary Hotel operations manager Jamie Pang’s application for his lawyers to see him.

“I cannot proceed with hearing this application as the State and related parties are not made aware (of this application),.

“It is improper to proceed hearing of this application without giving the State and related parties the opportunity to explain to the court whether or not Pang was unlawfully detained by the immigration.

“There are also other related criminal charges against Pang which are still pending in court.

“The State and immigration director must be given an opportunity to be heard in court,” he added.

DEPUTY Chief Justice Ambeng Kandakasi has refused to hear Sanctuary Hotel operations manager Jamie Pang’s application for his lawyers to see him.
“I cannot proceed with hearing this application as the State and related parties are not made aware (of this application),” Justice Kandakasi said on Friday.
“It is improper to proceed hearing of this application without giving the State and related parties the opportunity to explain to court whether or not Pang was unlawfully detained by immigration.
“There are also other related criminal charges against Pang which are still pending in court.
“The State and immigration director must be given an opportunity to be heard in court.”
He said he made an order on Feb 4, when the queries were raised by Pang’s former lawyer for the police, State and the immigration to allow Pang’s lawyers to see Pang when required.
“I have already made an order and it must be executed,” he said.
“But, we must also understand that immigration and border security have their own rules and we must respect that.” Kandakasi said he would not make any order on the application and ordered Pang’s lawyer Greg Sheppard to inform the State through the Office of the Solicitor-General and the chief immigration officer on the application. He further ordered for Solicitor-General and a representative and the immigrations to come to court today.
