DEPUTY Chief Justice Ambeng Kandakasi says he will not release Sanctuary Hotel operations manager Jamie Pang.
“Instead, I will grant access to the counsel to get proper evidence from Pang who is detained at the Bomana Immigration Centre,” he said on Friday.
Pang, 43, from Sydney, was detained at the centre for allegedly breaching the immigration law.
The order came following Pang’s lawyer Simon Nutley’s motion that Pang be released from the centre.
Nutley said the two affidavits supporting the motion were of Pang’s wife, Isabella Pang.
Justice Kandakasi asked Nutley and other defence counsels whether they had obtained any information from Pang apart from his wife.
Nutley told the court that the explanation of not having any sort of information from Pang was contained in the affidavit of his wife filed on Jan 31 and Feb 1.
He said Isabella was denied access to see her husband (Pang) but only on certain times to speak to him on the phone.
Justice Kandakasi then asked if the lawyers had made any attempt to speak to the relevant authority on this matter.
He ordered the defence to provide the court with copies of any charges and process administered.
Nutley said it was quite a big order for them (defence lawyers) without the presence of the other party.
“We had requested the other party to inform us of the procedures under the immigration act,” he added.
Justice Kandakasi then said the best way forward was to allow access for counsel to speak to Pang and for the other party to serve the charges on the return of this matter.
