‘K1 sex’ man on trial

PORT MORESBY: Paying K1 does not give anyone the licence or right to rape a 12-year-old girl, Lae committal court senior magistrate Pious Tapil says.

“In this case, the girl is alleged to be mentally slow in thinking. And you paid the K1 (after sex),” he added.

Tapil then committed an elderly man, Jack Tolo, to stand trial in the National Court for allegedly raping the girl on Oct 25.

PAYING K1 does not give anyone the licence or right to rape a 12-year-old girl, Lae committal court senior magistrate Pious Tapil says.
“In this case, the girl is alleged to be mentally slow in thinking. And you paid the girl K1,” he added.
Magistrate Tapil then committed Jack Tolo, an elderly man, to stand trial in the National Court for allegedly raping the girl on Oct 25.
(He allegedly paid the girl K1 each time after sexually abusing her.)
Magistrate Tapil told Tolo, from Daru’s Dimiri village in Western, that he found sufficient evidence against him based on statements provided by witnesses.
He said cases involving rape of minors had become prevalent in communities today and the courts were trying to help minimise such offences committed on vulnerable people.
“This is happening at a very alarming rate and are usually committed by the very people that the victim may have some kind of relationship or are entrusted to.
“A medical report points to you (Tolo) having raped the girl.
“This is the piece of evidence that the court has on hand to rule that you have a case to answer in the National Court on Wednesday.”
The medical report also confirmed that the age of the girl as under 16 and that she was only 12 when she was allegedly raped.
Tolo is alleged to have raped the girl Oct 25 in Lae, after her parents left for work.
While the girl was with her elder sister at home, the alleged rape occurred when the elder sister left home for the bus stop.
The girl’s parents returned home and found out about rape and lodged a police report.
