A 41-YEAR-OLD father, who is a school teacher, will be tried in the National Court next week for allegedly raping his 17-year-old daughter last year in Central.
Central Committal Court Magistrate Kilandi told the father from Rivali village in Rigo: “You are now committed to stand trial in the National Court because there is sufficient evidence provided by the police to sustain the charge.”
The court was told that on July 19 last year, the father hit his daughter several times before removing her clothes and sexually penetrated her for about two minutes.
The matter was reported to the police and the trial is scheduled for Nov 28.
In a separate case, a 70-year old man will stand trial in the National Court over the alleged rape of his 14-year-old grand-daughter.
Magistrate Kilandi told the grandfather (named) of Koko village, Bereina in Central that despite his medical conditions, he would stand trial as there was enough evidence against him.
“I have come up with the decision that since the victim is your own grand-daughter, and the alleged incident happened in the home where there should be trust, you can go and defend yourself in the National Court during trial,” Magistrate Kilandi said.
The trial has been set for Nov 28.
The court was told that the girl was trying to change her clothes after bathing in her uncle’s house when the grandfather allegedly raped her twice.
She reported the matter to her mother who took her to a health center before it was reported to police.
In Lae yesterday, a man charged with one count of rape was remanded at Buimo Prison to allow police to complete his files.
Magistrate Pious Tapil, when remanding Koty Fredy, 28, of Sinasina-Yongomugl’s Silma village, Chimbu, told him that the crime was serious.
Police allege that on Nov 6, Fredy committed the crime at Second Seven, Bumayong in Lae.
The victim is a person living with a disability. The case will next be called in court on Feb 8, 2023.

Stepdad gets 20 years for rape

A MAN, 64, was jailed 20 years with hard labour yesterday after being found guilty of persistently raping his two step-daughters.
He was given 55 years in total taking into account each count, but reductions, pre-sentence time in prison and his age finally left him with 20 years.
Justice John Kaumi in the National Court in Buimo when sentencing the man, from Kabwum in Morobe, said rape was a crime of violence and invasion of the most private part of a female.
The court heard that between January, 2017, and Jan 31, 2019, he committed four counts of rape on one step-daughter and once on the other.
Justice Kaumi said the man would serve 10 years for each of the first four counts, totalling 40 years.
He said another 15 years were to be added for the other daughter and the prisoner was to serve a total of 55 years.
“You spent three years and nine months in custody already so the court will deduct that from the 55 years. The court, in considering your age, will further deduct 30 years and three months, which brings the total to 20 years that you will spend in prison,” Justice Kaumi said.
Justice Kaumi said the sentence should serve as a deterrent to step-fathers and step-brothers who rape family members, especially female members.
“The justice system is trying its best to ensure such prevalent offences in the society is minimised as much as possible. Men cannot go around and sexually abuse their female family members at their own will,” he said.
The court heard that the man had sex with his step-daughters while working for a government department in Lae.
Justice Kaumi made an order on the man’s request that he would serve his sentence at Bihute Prison in Eastern Highlands.
