THE state’s application to revoke bail for former Lagaip-Porgera MP Philip Kikala is set for hearing next month.
Justice David Cannings, presiding as a single Supreme Court judge at Waigani on Nov 28, set Dec 19 for hearing following advice from the State that it had filed and served necessary documents on Kikala.
On May 19, 2017, following a trial, Kikala was found guilty of four counts of misappropriating K1,107,100 belonging to the people of Lagaip-Porgera in Enga.
On Nov 2, he was jailed seven years.
The court had ordered that five years of the sentence be deducted if he repaid the full amount at any time.
Kikala then filed two appeals against his conviction to the Supreme Court.
One was an application for leave to appeal the conviction based on a question of fact alone and the other was an appeal against conviction on a question of mixed facts and law.
After lodging his appeal, Kikala applied for bail before Justice Elenas Batari in 2018.
On May 25, 2018, the court granted him K10,000 bail with conditions which included taking all necessary steps to prepare and prosecute his appeal by the date of the first anniversary of his sentence, being Nov 2, 2018.
According to the public prosecutor’s records, Kikala failed to appear personally or through his lawyer during Supreme Court directions hearing on a number of occasions and the matter was adjourned to the registry.
To date, Kikala has not taken necessary steps and not taken any action on his appeals.
