Woman jailed 9yrs for New Year Day’s murder

PORT MORESBY: A woman was jailed nine years by the National Court for a New Year’s Day murder in Port Moresby on Jan 1, 2021.Acting Judge Laura Wawun-Kuvin saied drinking alcohol and causing violence during the festive season was prevalent, but a life lost could not be replaced.

A JUDGE says drinking alcohol and causing violence during the festive season is prevalent, but a life lost cannot be replaced.
Acting judge Laura Wawun-Kuvi provided a timely caution in the National Court at Waigani yesterday when jailing a woman nine years.
The woman was under the influence of alcohol and killed a man using an empty bottle at Wildlife settlement in Port Moresby on New Year’s Day last year.
Wawun-Kuvi told Wari Kundai, from Wapenamanda’s Tsak Valley in Enga, that even though she was initially attacked by the deceased, Paul Kirimai, she made the decision to strike the deceased with the bottle.
“Because of your actions, he died,” Wawun-Kuvi said.
“Your sentence is nine years. There is no suspension because this is a serious offence, a life was lost.
“Even after you serve your time in prison, you will be discharged and go back to the community and your family will get to see you.
“This is not the same for the deceased.
“It’s a prevalent offence, people get drunk and become violent.”
Kundai was charged with murder after an incident on Jan 1, 2021 when she struck Kiramai with a bottle of beer following an argument.
The injuries he had sustained led to his death.
The court heard that Kundai, who had been drinking at a residence near where Kirimai was living, was approached by him and his wife for beer and an argument broke out.
Kundai was subsequently attacked by Kiramai and his wife who threw beer bottles at her and struck her in the head.
Kundai had retaliated and struck Kiramai several times with one of the bottles, cutting him and causing a blood clot which killed him.
The court said there were proper processes in place where help could have been found and that was to lay a complaint with the police or settle at the village court.
Wawun-Kuvi said the court had considered the facts that Kundai had pleaded guilty, apologised and shown genuine remorse.
She had cooperated with police during investigation and record of interview.
Kundai had also compensated Kiramai’s families in Enga and Port Moresby which was accepted.
Wawun-Kuvi said the nine years would not be suspended.
