12-year jail sentence on woman for killing hubby’s 18-year-old lover remains

PORT MORESBY: A 38-year-old woman who was jailed 12 years for killing her husband’s 18-year-old lover has failed in her appeal for a reduced sentence.

A three-man Supreme Court bench dismissed her appeal because the National Court did not err in the sentence.

A THREE-man bench Supreme Court has dismissed an appeal by a woman who was sentenced 12 years for killing an 18-year-old woman in Port Moresby three years ago.
Marcia Pau, 38, appealed against her jail term, saying the National Court judge had erred when making the decision and the 12 years of imprisonment was excessive.
Three-man bench, comprising of Justice Kina Bona, Justice Frazer Pitpit and chaired by Justice Panuel Mogish, said they did not find any errors in the decision by the judge in the National Court.
“We do not find any identifiable error by the trial judge,” Justice Mogish said.
“The decision was based on the aggravating factors contained in the case, we do not find any mistakes in the decision on the sentence.”
Pau, in her appeal, said the 12 years was too much.
She submitted that the National Court judge did not seriously consider the emotional stress and mental stress her husband had put her through, leading up to the act of killing the girl.
Pau added that there was provocation in her case which the National Court judge did not consider but instead based the decision on sentence on the aggravating factor.
Justice Mogish dismissed Pau’s grounds for appeal.
Pau pleaded guilty to the charge of manslaughter and was sentenced 12 years last Oct 11.
Five years of her jail term was suspended and she will serve the remaining seven at Bomana prison.
She was further ordered to be on good behaviour bond for three years after her release from serving the seven years.
Pau, mother of five, was a teacher at Koki Primary School in 2019 and the victim was the neighbour’s daughter who was doing grade seven at that time and was friends with one of Pau’s daughters.
The girl was allegedly having an affair with Pau’s husband.
