PORT MORESBY: The
Supreme Court has given a Filipino, jailed 30 years for shooting dead a man in Gordon
Boroko Foodworld four years ago, more time to file his appeal against sentence.
Justice David Cannings in Waigani yesterday (Nov 7, 2022) was advised
that the Public Solicitor’s Office was yet to file the notice of appeal against
Edson Alojipan’s sentence.

THE Supreme Court has given a Filipino,
sentenced to 30 years for shooting dead a man in Gordon Foodworld four years
ago, more time to file his appeal against sentence.
Justice David Cannings in Waigani yesterday was advised that the Public
Solicitor’s office was yet to file the notice of appeal against sentence for
Edson Alojipan. He noted that according to court records, leave was granted to
Alojipan, from Iloilo City, on Oct 12, to review his sentence.
When the matter came to court last Tuesday, Justice Cannings directed the
defence to file a notice of appeal against sentence by Oct 28, and adjourned
the matter to yesterday for hearing.
Justice Cannings then fixed Nov 14 for next hearing.
On Feb 15, 2018, in the supermarket, Alojipan shot Jeffery Verlarde with a
Glock handgun and injured two children who were metres away.
According to court documents obtained by The National, Alojipan was appealing
the excessiveness of the jail term given that the sentencing judge had failed
to take into consideration pre-sentence of provocation as a special mitigating
factor.
Alojipan is also appealing his conviction of wilful murder on the grounds that
the trial judge had erred in rejecting his defence of “self-defence”.
Among the grounds of appeal are that there was circumstantial evidence
consistent with Alojipan’s evidence that Verlarde had drawn his weapon, given
that Verlarde’s dropped his firearm on the floor.
