MP’s wife claims misappropriation charges

PORT MORESBY: Tambul-Nebilyer MP Win Bakri Daki’s wife
has asked a committal court in Waigani to dismiss her misappropriation and
stealing charges, saying that it was falsely laid against her and had no proof
to support it.

Nellie Kepo said the evidence in the police file did not meet the elements of
the charge against Daki because the K4.2 million which was alleged to have been
misappropriated was still in the company’s account.

Bakri Daki’s wife Esther Daki has asked a court to dismiss her misappropriation
and stealing charges saying that it was falsely laid against her and had no
proof to support it.
Esther Daki’s lawyer Nellie Kepo said the evidence in the police file did not
meet the elements of the charge against her client because the K4.2 million
which was alleged to have been misappropriated was still in the company’s
account.
She said this during her submission on evidence before magistrate Danny
Wakikura in the Waigani Committal Court yesterday.
“Although the money was transferred from the Weklem Ltd company’s account to
her account, Esther did not withdraw any amount for her personal use,” she
said.
Kepo added that it was not possible for Esther to withdraw money from the
company’s account by herself because she and Win were both the signatories of
the accounts.”
She said there was evidence that Win had already recouped K3.035 million from
her client’s account with K1.165 million yet to be recouped.
She said that all account transactions totalling up to K4.2 million as alleged
by police were never done without Win’s knowledge and approval.
Kepo said police had not established the elements of the misappropriation
charge against Esther because she was transparent in her conduct of
transferring or using the money for anything other than its intended purpose.
Police prosecutor Senior Sergeant John Wemuru objected saying there was enough
evidence before the court to rule on.
“There is no issues with how they deal with their business because they are
married and have children,” he said.
“The allegation before the court was that the transaction was done without
authorisation by the company’s owner who is the complaint.”
